Terms of Service

Summary: DrumSplit sells non-expiring splits for audio processing, requires you to own rights to the audio you upload, limits liability, and lets you request refunds on unused splits within 7 days.

1. Agreement to Terms

By accessing or using DrumSplit.io ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

DrumSplit is a neural audio processing service that separates drum elements from audio files. The Service uses a two-stage pipeline to isolate drums from a full mix, then separate them into 5 individual stems: kick, snare, hi-hats, toms, and cymbals.

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activity under your account

4. Splits and Payment

Demo Splits:

• Up to 5 demo splits per 24 hours, no account required
• Demo splits process up to 5 minutes of any uploaded track
• Full-length processing requires a paid split

Split System:

• Splits are purchased to process audio files
• Each file separation requires one (1) split
• Splits are deducted when processing begins and refunded if processing fails
• Splits never expire
• Splits are non-transferable between accounts

Payments:

• All payments are processed securely through Stripe
• Prices are displayed in USD
• We reserve the right to modify pricing with notice

Refunds:

• Unused splits may be refunded within 7 days of purchase
• Splits that have been used to process files are non-refundable
• If a processing error occurs, we will re-add the split to your account
• Refund requests: email support@drumsplit.io

5. Acceptable Use

You agree NOT to:

• Upload files you don't have rights to process
• Use the Service for any illegal purpose
• Attempt to reverse engineer or copy our AI models
• Abuse, harass, or spam our systems
• Share account credentials with others
• Circumvent payment or split systems

6. Intellectual Property

Your Content: You retain all rights to audio files you upload. We do not claim ownership of your content. You are solely responsible for ensuring you have the necessary rights to process any audio you upload.

Our Service: DrumSplit, our neural separation models, website design, and all related intellectual property are owned by us and protected by copyright and trademark laws.

Output Files: You own the separated stem files generated from your uploads. You may use them for any legal purpose consistent with your rights to the original audio.

7. DMCA and Copyright

DrumSplit is a processing tool. We do not host, distribute, or publicly display user-uploaded audio. Users are responsible for ensuring they have the rights to process any audio they upload.

If you believe content processed through our Service infringes your copyright, please send a DMCA takedown notice to:

Include: (1) identification of the copyrighted work, (2) identification of the infringing material, (3) your contact information, (4) a statement of good faith belief, (5) a statement under penalty of perjury, and (6) your physical or electronic signature.

We will respond to valid DMCA notices in accordance with the Digital Millennium Copyright Act.

8. File Processing and Storage

• Uploaded files are processed and then immediately deleted
• We do not store your audio files after processing
• Output stems are available for download for 24 hours
• Paid users receive an email notification when stems are ready
• Maximum file size: 100MB
• Maximum file length: 8 minutes
• Supported formats: MP3, WAV, FLAC, AIFF

9. Service Availability

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. We reserve the right to:

• Perform scheduled maintenance
• Modify or discontinue features
• Limit processing during high demand

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" without warranties
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the past 12 months
• We are not responsible for the quality or accuracy of AI-generated separations

11. Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Abuse the Service or other users

You may delete your account at any time by emailing support@drumsplit.io. Unused splits will be refunded within 7 days of account deletion.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of material changes via email.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.

14. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except you may bring claims in small claims court.
